Respect et courtoisie: le droit d'auteur

"Ne fais pas aux autres ce que tu ne voudrais pas qu’ils te fassent… » Passée dans le patrimoine collectif, cette formule ne pose pas seulement la question du droit d’auteur. On devrait même l’afficher partout dans la blogosphère tant son application y reste aléatoire…

Aimeriez-vous voir affiché sur un blog, sans la moindre allusion à son origine (votre blog, votre site, votre livre), et sans la moindre demande d’autorisation,… cochez, au choix :

Ce texte qui vous a demandé tant d’efforts de collecte de renseignements, tant d’heures de travail ?
La formule concoctée avec amour de votre nouvelle création cosmétique?
La recette de la confiture de grand-maman ?
Le tutoriel de votre objet brico-déco ?
La photo de votre jardin ou de votre salon ?

Pourtant, c’est ce qui arrive bien souvent dans la blogosphère. Ecrivains internautes en herbe et tambouilleuses de tout poil oubliant leurs plus élémentaires devoirs en matière de respect du droit de la propriété intellectuelle, du droit d’auteur…et tout simplement de savoir-vivre.

Le droit d'auteur

Petit rappel à partir de l'encyclopédie Wikipedia: le droit d'auteur désigne essentiellement les droits de revendiquer la paternité de l'œuvre, de décider du moment de sa publication, de s'opposer à toute déformation ou mutilation de l'œuvre et à toute utilisation pouvant porter atteinte à la réputation ou à l'honneur de l'auteur.

Une œuvre originale, quelle qu’elle soit, est la propriété de son auteur, sans que celui-ci ait la moindre démarche administrative à effectuer. Et elle reste sa propriété tant que l’auteur ne la rend pas libre de droits ou ne cède ces droits.
Les moyens visant à protéger le droit d’auteur sont uniquement utilisés pour avoir la possibilité d’ apporter la preuve de cette propriété en cas de litige. Ils ne sont pas obligatoires. En leur absence, néanmoins, difficile de se défendre devant un tribunal.

Pour citer dans les règles de l'art et de la courtoisie, les quelques lignes seront entre guillemets ou en italique avec un lien qui renvoie explicitement à l’original si on le trouve sur le net, ou (s’il s’agit d’un livre) avec mention du titre, de l’auteur et de l’éditeur et pourquoi pas un renvoi vers un site où l'ouvrage est disponible.

Le respect de la loi n'est pas tout. Il y a aussi celui du savoir-vivre… Se contenter de changer 3 mots à un article, de rajouter 3 pincées d’un ingrédient sans intérêt, de remplacer l’eau de rose par une infusion de pétales de rose dans une formule de lotion et revendiquer la nouveauté de son travail relève du mensonge et du plagiat.
Le contenu des blogs n’est pas le seul à être copié, puisque la mise en forme des blogs qui ont du succès sont aussi soumis à ce qu'on peut appeler du "piratage”. Le choix d’un support (over-blog, canal blog, etc. ) conditionne certes la charte graphique, mais l’internaute blogueur a de nombreux paramètres à sa disposition pour ajouter sa touche personnelle…

Poster une n-ième recette de gommage qu'on retrouve partout en se contentant d'un commentaire élogieux sur son odeur, c'est bon pour l'ego mais peut-être pas très intéressant pour la blogosphère. Même s’il peut –parfois- puiser son inspiration ailleurs, un blog original doit toujours apporter quelque chose en plus: un commentaire personnel, des anecdotes qui enrichissent, des variantes significatives (s’il s’agit d’une recette…), la synthèse commentée de plusieurs sources…

Donc :

Ne recopions pas un autre blog ou site, même un fragment, sans accord de son auteur. Si l'auteur donne son accord, on le cite et on effectue un lien vers son site.
Démarquons-nous visuellement de nos blogs favoris même si nous en admirons la mise en page.
Illustrons les articles avec des photos et dessins libres de droits ou avec l’accord de leur auteur, en intégrant un lien internet renvoyant vers lui (pour plus d'information sur les images, cliquer ici). Idem pour les illustrations sonores (sinon gare à la SACEM! D'ailleurs, le texte des paroles est également protégé). Utilisons un fichier enregistré chez vous et non un hotlink (cliquer ici pour tout savoir sur le hotlink).

Si nous voulons que le monde des blogs reste agréable à visiter, si nous souhaitons qu’il conserve une certaine fraîcheur, de l’intérêt, qu’on ne s’y perde pas dans une masse redondante et lassante, réfléchissons, avant de nous lancer dans l'aventure bloguesque, à ce que nous pouvons apporter aux autres…
